U.S. seeks tighter control over Apple in e-book case

NEW YORK: Apple Inc is headed for a showdown with the U.S. government and dozens of states, which on Friday urged that tough new restrictions be imposed on the company for illegally conspiring to raise e-book prices.

The changes proposed by the U.S. Department of Justice and 33 U.S. states and territories are designed to stop Apple from committing further antitrust violations after U.S. District Judge Denise Cote said on July 10 Apple had a "central role" in a conspiracy with five major publishers to raise e-book prices.

But the proposed changes extend beyond e-books, potentially limiting Apple's ability to negotiate for such content as movies, music and TV shows, and increasing regulatory oversight of other business areas such as the company' App Store.

In a court filing, Apple called the proposed injunction a "draconian and punitive intrusion" into its business that would hurt consumers and competition, and was "wildly out of proportion" to the harm it was meant to address.

"The resulting cost of this relief - not only in dollars but also lost opportunities for American businesses and consumers - would be vast," it said.

Federal and state regulators disagreed.

"Under the department's proposed order, Apple's illegal conduct will cease, and Apple and its senior executives will be prevented from conspiring to thwart competition," said Bill Baer, head of the Justice Department's antitrust division.

Cote will weigh the arguments at an Aug. 9 hearing in her Manhattan courtroom. A damages trial might follow.

Despite Apple's protests, analysts have said the bigger issue for the Cupertino, California-based company in this case might be damage to its reputation, not financial harm.

Amazon.com Inc commands about 65 percent of the U.S. e-books market, while Apple's share has been estimated in the single digits.

The governments' plan, which needs court approval, would require that Apple end its contracts with the five publishers and be banned for five years from entering contracts that would effectively raise prices of e-books sold by rivals.

The publishers are Lagardere SCA's Hachette Book Group Inc, News Corp's HarperCollins Publishers LLC, Pearson Plc's Penguin Group (USA) Inc, CBS Corp's Simon & Schuster Inc and Verlagsgruppe Georg von Holtzbrinck GmbH's Macmillan. All settled with U.S. regulators.

Apple would also be unable to cut deals with providers of movies, music and TV programs for its iPad tablets and iPhones that would likely increase the prices at which rivals might sell such content.

Officials also want to make it easier for consumers to compare e-book prices by requiring Apple for two years to let Amazon, Barnes & Noble Inc and other rivals provide links to their own stores within their iPad and iPhone apps.

Industry experts said the proposal, if adopted, could solidify Amazon's dominance in the e-books market.

"Why isn't the DOJ forcing Amazon to play fairly? This is the question the publishing industry wants answered," said Mark Coker, founder of Smashwords, an e-book publisher and distributor that works with Apple, Barnes & Noble and other companies. "Apple brought much-needed competition to the e-book market and now the government is trying to undermine them."

Albert Greco, a book-industry expert at Fordham University's business school, said the proposal "does not address the long term issue of book pricing in the United States."

The plan also requires Apple to hire a full-time internal antitrust compliance officer, and use a court-appointed external monitor to ensure its compliance with the proposed final judgment for 10 years.

Government officials said the changes would permit Apple to compete "vigorously and lawfully" in the e-books market.

Apple countered that the changes seek unnecessary relief for harm already remedied under the settlements with the publishers. It urged Cote to reject the injunction entirely or approve a "narrower and more modest" alternative.

Federal and state officials accused Apple of conspiring with the publishers in late 2009 and early 2010, as the iPad was being launched.

They said the conspiracy caused some e-book prices to rise to $12.99 or $14.99 from the $9.99 that Amazon charged.

Evidence damaging Apple's case included emails from Steve Jobs, its late chief executive, that the officials said reflected a desire to boost prices.

"Taking advantage of the publisher defendants' fear of and frustration over Amazon's pricing," Cote concluded, "Apple seized the moment and brilliantly played its hand."

In their settlements, the publishers agreed to pay more than $166 million for consumers' benefit. None admitted wrongdoing.

Oakland A's see advantage dwindle after loss to Texas Rangers

OAKLAND -- It's already been a crazy race between the A's and Texas Rangers in 2013, and it looks as though it's going to get wilder and wackier over the final two months.

On May 15, Texas led the American League West by seven games. By July 26, there had been a 13-game swing, with the A's opening up a six-game advantage.

Now it appears to be swinging back the other way again -- and quickly.

The Rangers came into a sold-out Coliseum on Friday night (35,067) riding a four-game winning streak and promptly walloped Oakland 8-3.

Texas' recent run has shaved the A's seemingly comfortable six-game lead to just 2? games in just four days.

"They've played us well all year," said Brandon Moss, whose two-run double in the first inning turned out to be Oakland's biggest hit of the night. "They've definitely had our number a little bit. We need to come out and win some games against them and get some confidence going."

Indeed, the Rangers have won seven of 11 this season from the A's, who have lost three straight games for the first time since early May.

On this night, Texas pounded Tommy Milone (9-9) for nine hits and six runs in just 3?2/3 innings. Nelson Cruz and Jurickson Profar each hit two-run home runs off the A's left-hander.

This could be just the start of the bad news for the A's. If the Rangers can get out of town by winning the series, they're set up nicely for a longer haul -- they'll play 24 consecutive games against teams with losing records before they return to Oakland again on Sept. 2.

The A's, by contrast, will play teams with winning records 15 of the next 24 games after this series.

Milone started the game like he was locked in -- all 10 pitches he threw in the first inning were strikes, and he was hitting his spots. But it all went downhill from there.

"Pretty terrible," Milone said. "I felt fine early on, in the bullpen and the first inning. Even the second inning, I only made one bad pitch (the Cruz homer). But from the third on, it just kind of escalated. I started leaving balls out over the plate. A couple big hits, and there's six runs."

Milone, who fell to 0-4 against the Rangers in five career starts, didn't survive the fourth inning. Craig Gentry lined a one-out double past third baseman Josh Donaldson, and rookie Profar followed with his fourth homer of the year, a line shot over the left field fence. Dan Otero replaced Milone with two outs in the inning.

Oakland got one run back in the bottom of the fourth on a Josh Reddick leadoff walk and a run-scoring double to right by Coco Crisp.

But early on, the A's were squandering more opportunities than they were cashing in against erratic Texas starter Alexi Ogando,

Ogando threw 60 pitches and walked four batters in the first two innings alone, but the A's could manage only the two runs. In the third, they had first-and-third with one out after back-to-back singles by Yoenis Cespedes and Moss, but Donaldson -- who hasn't had an RBI since the All-Star break -- hit into a double play.

Ogando was gone after four innings having thrown 92 pitches, and the A's subsequently loaded the bases against his relief, left-hander Robbie Ross. Jed Lowrie opened the inning with a single, and after two were out, Donaldson singled and Reddick walked. But pinch-hitter Alberto Callaspo flied out to center against reliever Jason Frasor (2-2) to end Oakland's last legitimate threat.

The A's left 10 men on base and are now 1 for 19 with runners in scoring position the past two games.

"There were some opportunities for us that we didn't cash in, and on the flip side, they did cash in on their opportunities," manager Bob Melvin said.

  • Adam Rosales, designated for assignment by the A's on Wednesday, was claimed on waivers by the Rangers and was in the opposing dugout after 3? seasons with Oakland.

    "I was shocked but excited at the same time," Rosales said. "It's obviously bittersweet. I was with the A's for four years. I felt like I grew up a lot. But this is great. I'm ready for this new chapter in my baseball life."

    Even though Rosales now plays for a division rival, the A's were happy for him.

    "We'd probably rather he be in a different uniform, with someone in the National League that we don't play," Melvin said. "But everybody's pretty fond of Rosie, and the fact that he's back in the big leagues again is good for him."

  • Brett Anderson threw a live batting practice session before the game, and the A's will announce Saturday whether the left-hander is ready to begin a rehab assignment. Anderson threw two 15-pitch B.P. stints to hitters in addition to 25 pitches on the side.
  • John Jaso will undergo further testing Saturday for the concussion that has put him out of action for a week. Melvin said Jaso is improving, but the catcher is not expected to play this weekend.

    Kirobo the talking robot blasts into space on historic mission

    (Reuters) - Kirobo, a knee-high talking robot with red boots and a black and white body, has blasted off from Japan for the International Space Station to test how machines can help astronauts with their work.

    The Japanese-speaking robot, equipped with voice- and facial-recognition technology, was packed into an unmanned cargo vessel along with tons of supplies and equipment for the crew of the orbital research base.

    The cargo vessel, launched from the Tanegashima Space Center in southwestern Japan on Sunday, will arrive at the outpost on Friday, according to the Japan Aerospace Exploration Agency's website.

    At a recent demonstration, Kirobo said it "hoped to create a future where humans and robots live together and get along".

    As it carries on the first robot-human chats in space, Kirobo's main conversation partner will be Japanese astronaut Koichi Wakata, who is expected to take off for the space station with six other crew members in November.

    Wakata is due to take command of the complex, a $100 billion project by 15 nations, next March. Kirobo - jointly developed by the University of Tokyo, Toyota Motor Corp and Dentsu Inc - will stay in space until late 2014.

    Standing 34 cm (13 inches) tall and weighing about 1 kg (2.2 pounds), Kirobo is designed to navigate in zero gravity and gets its name from "kibo", the Japanese word for "hope", and "robot".

    This week's big questions: Has the Edinburgh Fringe grown too big? Has Twitter gone too far?

    There are more places to eat. Seriously, it?s pop-up this and noodle that and I?ve already spotted a bratwurst van near my venue ? I do love sauerkraut. I used to come up to Edinburgh and guarantee losing a stone: fear and cigarettes for a month is a really effective diet. Now that I have given up the fags and am consequently very greedy, I will have to keep an eye on my sausage consumption. There are also loads more gyms and health clubs, unfortunately. I liked it when Edinburgh thought gyms were a bit sissy.

    Is the Edinburgh Fringe too big? Would it not better for so much talent to be spread about the calendar and the country?

    This city is the ideal size for a festival, but I do fear it?s getting borderline obese. The fringe brochure is bewildering and I?ve been saying for years that the festival needs trained Fringe ?Buddies? on hand to guide confused punters through the maze. These could be out-of-work performers which would add a nice touch of bitterness to the scheme. You?ve got to get organised, plan your route, carry a banana with you, and remember while it might be pissing down outside, your venue is likely to be sauna hot. If you need to strip down to your bra, make sure it?s a pleasant one.

    You seem to enjoy Twitter but its dark side is coming to the fore. Why is that?

    Argh, how sad that the playground should occasionally turn into a cesspit. I?ve been moderately lucky ? a few ?you?re shit? comments but, on the whole, much laughter, loads of information and lots of friends. The downside of social networking is that horrible people can hide behind fictional identities. The reality of most trolls is that they are socially incompetent, but that doesn?t necessarily mean they are harmless.

    How best to respond to trolling?

    Block, block, block. Occasionally, I will get a snide comment and if I react, the comment will be removed or I?ll get an apology. Twitter is very open to misinterpretation, especially when no one bothers with grammar. I?ve taken offence on a few occasions, because I?m prickly and I?ve read something the wrong way. Thing is, you?ve got 140 characters, so if you?ve made a boo-boo you?ve always got enough space to say sorry.

    Typical nimbyism. I?m scared of fracking. This country is too small to risk it. My parents live up in Lytham St Anne?s near Blackpool, which was fracked a few years ago ? and subsequently had a small earthquake. You can call it a tremor if you like, but the earth moved and it wasn?t good for me. I always think of the earth?s crust as being a bit biscuity. Fracking is like drilling into a massive Ryvita: bits are going to start breaking off. It?ll all end in tears and crumbs.

    How? I?ve never had to stop my daughter doing anything. They have to develop their own moral code. Doesn?t mean I haven?t used other snooping methods, but I think (from what I can gather) Facebook puts kids under horrible pressure to be seen to be having ?fun?. I try to avoid it as much as possible.

    Great work for graduates! I see it from the POV of being the parent of a 24-year-old; there?s not much out there for tons of bright post-uni kids. There?s always the hope a good tutor will inspire where a dull teacher won?t, but it shouldn?t be necessary. What?s weird is that it tends to be parents who have already opted into the fee-paying system who are forking out for tutors on top of school fees! That?s like volunteering to pay twice for the same thing, which is a bit mad.

    The Olympic Games and the Diamond Jubilee have, we are told, made Britain a happier place. Was that the effect they had on you?

    Yes, it?s good to be reminded that we are stylish and plucky. My natural inclination is to sneer at everything, but both occasions proved just how brilliant we are at putting on a show and how cool we are even when we?re doing something madly traditional. I thought the river procession would leave me completely cold, but fortunately on the day I was invited into a set of barristers? chambers overlooking the Thames ? so I was kept completely warm, dry and stoked up on chicken thighs.

    A Hijacking is one of those perfect films that crop up every few years to prove that with true artistry, even the most exhausted genre can yield something new, rich, and strange.

    Lindholm justifies his confidence in a visual approach that's refreshingly realistic.

    To refuse to call A Hijacking a thriller is not to say it isn't thrilling, in a dryly cerebral way.

    A tense, gripping drama filled with psychological showdowns from Danish writer-director Tobias Lindholm.

    ... has an embedded feel without being a real-life report or documentary at all. It's a fictional film that hits both with blunt force and a surprising amount of complexity.

    A Hijacking is more about one incident than about how it relates universally, but in thoughtfully exploring the specifics and emotions of that incident, Lindholm is able to show how modern life sometimes seems devoid of any accord.

    A lean, stressful nail-biter, smart, well-written, nicely shot and wonderfully performed.

    [Omar and Mikkel are] like Marcus and McTeague in Frank Norris's 1899 novel, handcuffed to each other in a struggle that could well end in mutually assured destruction.

    Tobias Lindholm's slow-burning thriller makes a bid for verisimilitude that extends well beyond the use of natural light and handheld cameras.

    Though the acting in "A Hijacking" is superb, the film is strictly a "follow-the-dots" offering. This is not entertainment. It is another overwhelmingly depressing foray into corporate greed.

    "A Hijacking", if eligible, is an early contender for Best Foreign film at the 2014 Academy Awards.

    It's an effective piece of work that will leave you longing for a shower, a nap, and a warm meal.

    It's a radical departure from any thriller in stateside theaters.

    A nail-biter of the highest order, A Hijacking is astonishingly emotional, gritty, and terrifying -- a genuine directorial achievement that should not be missed.

    When the gut-wrenching conclusion of A Hijacking comes in the form of a single, random act, it's only then you realize how far you've been pulled into its emotional core.

    A Hijacking delivers all the thrills the title suggests, but in none of the places you'd expect them.

    I have a web part page with several web parts pulling and filtering data from 3 different lists on the same site. This page has worked fine for months, but this morning the error message in the post title shows up in every single web part.

    I know questions have been asked about this issue, and I have found?some pages where it was answered. Invariably, the "answers" consist of links to external blog pages such as:

    My problem is that these blog explanations lack explicity in how the commands should be typed in to SP2010 Management Shell. In the 2nd link, for example, some of the command line syntax is shown in screenshots (which is great), but some steps are explained in between screenshots, and the syntax seems to be inconsistent. I've tried several variations, but everything I've tried has resulted in errors in the power shell.

    I was hoping one of you experts could type out the commands explained in the above posts exactly as they should be entered into the SP2010 Mgmt Shell. Obviously you won't be able to tell me the ID, but please just use something like abcde12345 or something in place of it.

    In the summer of 1968, a new strain of influenza appeared in Hong Kong. This strain, known as H3N2, spread around the globe and eventually killed an estimated 1 million people.

    A new study from MIT reveals that there are many strains of H3N2 circulating in birds and pigs that are genetically similar to the 1968 strain and have the potential to generate a pandemic if they leap to humans. The researchers, led by Ram Sasisekharan, the Alfred H. Caspary Professor of Biological Engineering at MIT, also found that current flu vaccines might not offer protection against these strains.

    "There are indeed examples of H3N2 that we need to be concerned about," says Sasisekharan, who is also a member of MIT's Koch Institute for Integrative Cancer Research. "From a pandemic-preparedness point of view, we should potentially start including some of these H3 strains as part of influenza vaccines."

    The study, which appears in the May 10 issue of the journal Scientific Reports, also offers the World Health Organization and public-health agencies' insight into viral strains that should raise red flags if detected.

    Influenza evolution

    In the past 100 years, influenza viruses that emerged from pigs or birds have caused several notable flu pandemics. When one of these avian or swine viruses gains the ability to infect humans, it can often evade the immune system, which is primed to recognize only strains that commonly infect humans.

    Strains of H3N2 have been circulating in humans since the 1968 pandemic, but they have evolved to a less dangerous form that produces a nasty seasonal flu. However, H3N2 strains are also circulating in pigs and birds.

    Sasisekharan and his colleagues wanted to determine the risk of H3N2 strains re-emerging in humans, whose immune systems would no longer recognize the more dangerous forms of H3N2. This type of event has a recent precedent: In 2009, a strain of H1N1 emerged that was very similar to the virus that caused a 1918 pandemic that killed 50 million to 100 million people.

    "We asked if that could happen with H3," Sasisekharan says. "You would think it's more readily possible with H3 because we observe that there seems to be a lot more mixing of H3 between humans and swine."

    Genetic similarities

    In the new study, the researchers compared the 1968 H3N2 strain and about 1,100 H3 strains now circulating in pigs and birds, focusing on the gene that codes for the viral hemagglutinin (HA) protein.

    After comparing HA genetic sequences in five key locations that control the viruses' interactions with infected hosts, the researchers calculated an "antigenic index" for each strain. This value indicates the percentage of these genetic regions identical to those of the 1968 pandemic strain and helps determine how well an influenza virus can evade a host's immune response.

    The researchers also took into account the patterns of attachment of the HA protein to sugar molecules called glycans. The virus' ability to attach to glycan receptors found on human respiratory-tract cells is key to infecting humans.

    Seeking viruses with an antigenic index of at least 49 percent and glycan-attachment patterns identical to those of the 1968 virus, the research team identified 581 H3 viruses isolated since 2000 that could potentially cause a pandemic. Of these, 549 came from birds and 32 from pigs.

    The researchers then exposed some of these strains to antibodies provoked by the current H3 seasonal-flu vaccines. As they predicted, these antibodies were unable to recognize or attack these H3 strains. Of the 581 HA sequences, six swine strains already contain the standard HA mutations necessary for human adaptation, and are thus capable of entering the human population either directly or via genetic reassortment, Sasisekharan says.

    "One of the amazing things about the influenza virus is its ability to grab genes from different pools," he says. "There could be viral genes that mix among pigs, or between birds and pigs."

    Sasisekharan and colleagues are now doing a similar genetic study of H5 influenza strains.

    Aviva in talks to enter British rented housing market: FT

    (Reuters) - British insurer Aviva Plc could buy thousands of homes in London and the southeast of England to use as rented properties in a deal with social housing provider A2Dominion, the Financial Times reported on Sunday, citing people familiar with the situation.

    The two companies, which are in advanced negotiations, plan to launch a special purpose vehicle that would build a mix of social and open market rented houses, the FT said on its website.

    Insurers and pension funds are poised to spend 7 billion pounds ($11 billion) on rental homes in Britain in a bet that a shortage of housing and mortgages produces a generation of renters rather than owners.

    Larger rival Prudential Plc's said last month it would buy more than 500 private rental units from Berkeley Group for 105.4 million pounds.

    A2Dominion is one of Britain's largest social housing providers, owning 34,000 houses in and around London, according to the FT.

    Messiah College Students Slam Josh Ritter For Calling Christian School Anti-Gay

    Musician Josh Ritter, who refused to perform again at a private Christian college because of the school's anti-gay beliefs, is now the target of backlash from students who say they and their school are not homophobic.

    Ritter defended gay rights in a Facebook post criticizing Messiah College, a private school in Mechanicsburg, Pa., that embraces the "evangelical spirit rooted" in Christian traditions. In his May 4 post, Ritter blasted the school as anti-gay after discovering a school-wide document called the "Community Covenant."

    Messiah College requires all students to sign a "Community Covenant" promising to, among other things, ?avoid such sinful practices as?homosexual behavior?.? This policy, which I see as exclusionary and bigoted, could not run more counter to my personal beliefs. If I had done my homework, and read about Messiah's policies ahead of time, I would never have agreed to play there.

    Ritter -- who performed at the school on May 4 -- continued by saying he would not play at Messiah College again until the school welcomes all Christians, gay or straight. He plans to donate the fees he received for the performance to suicide-prevention group the Trevor Project.

    Messiah students are now striking back at Ritter saying their school is actually an accepting place.

    "[Y]ou have succeeded to put all of us Messiah students in a box, when in reality this characterization couldn't be further from the truth. The student body here is a diverse group, many of which are passionate for seeing change happen within the schools policies regarding homosexual behavior," wrote one Facebook user. "Your words are hurtful to many of us here who do not apply to the group you called out."

    "I love Messiah, and I love my faith, but I also believe that everyone has the right to love who they love and to be with you makes them happy," wrote another. "If you ask around campus, there are many things that students generally disagree with in the Community Covenant."

    Messiah has a copy of the "Community Covenant" available online. This document, subtitled "All of Life Under the Lordship of Christ," says that the teachings of the scriptures apply to all those in the school community. Students are asked to avoid: drunkenness, stealing, dishonesty, profanity, occult practices, sexual intercourse outside of marriage, homosexual behavior, and sexually exploitative or abusive behavior.

    A spokeswoman for Messiah told Christian magazine World on Campus that she was surprised Ritter wasn't familiar with the school's stance on sexuality until now, even though he performed there in 2009.

    "We are a Christian college, we would think it wouldn't be surprising that we hold a traditional Scriptural interpretation of sexuality," Beth Lorow said. "We feel disappointed that he opted to publicly express his disagreement with name-calling and labeling and passed on doing it in a more productive way."

    She said Ritter refused to speak to school administrators about his differing opinions and accused him of "not extending the openness and tolerance he spoke about to religious freedoms."

    CAPE CANAVERAL, Fla. (AP) ? Two astronauts took a hastily planned spacewalk Saturday to find and, possibly, fix a serious leak at the International Space Station.

    Flakes of frozen ammonia coolant were spotted Thursday drifting from the long frame that holds the solar panels on the left side. Less than 48 hours later, Thomas Marshburn and Christopher Cassidy emerged from the orbiting lab to hunt for the leak. They were prepared to replace a pump, if necessary.

    NASA said the leak, while significant, poses no safety threat. But managers wanted to deal with the trouble now, while it's fresh and before Marshburn returns to Earth in just a few days.

    The space agency has never staged such a fast, impromptu spacewalk for a station crew. Even during the shuttle days, unplanned spacewalks were rare.

    At the beginning of the spacewalk, neither astronaut spotted any flakes of ammonia or anything else amiss as they reached the spot in question and began an inspection.

    "I see nothing off-nominal," Cassidy said. He noted some smudges, but nothing more.

    The astronauts needed to take pictures of the equipment, but the connection to the camera's flash was not working and Marshburn had to wait until the space station reached the daylight side of Earth.

    Flight controllers in Houston worked furiously to get ready for Saturday's operation, completing all the required preparation in under 48 hours. The astronauts trained for just such an emergency scenario before they rocketed into orbit; the repair job is among NASA's so-called Big 12.

    This area on the space station is prone to leaks. The ammonia coursing through the plumbing is used to cool the space station's electronic equipment. There are eight of these power channels, and all seven others were operating normally. As a result, life for the six space station residents was pretty much unaffected, aside from the drama unfolding Saturday 255 miles above the planet.

    NASA's space station program manager Mike Suffredini said it's a mystery as to why the leak erupted. One possibility is a micrometeorite strike. If there is nothing to suggest that the old pump is at fault, then the spacewalkers expect to leave it in place and go back inside as flight controllers figure out the next step.

    Marshburn has been on the space station since December and is set to return to Earth late Monday. Cassidy is a new arrival, on board for just 1? months.

    "Suddenly very busy," Marshburn said via Twitter on Friday.

    By coincidence, the two performed a spacewalk at this troublesome spot before, during a shuttle visit in 2009.

    According to media reports, the US was alerted this week by Israel that Russia is preparing to begin deliveries, perhaps as early as this summer, on a $900-million contract for six S-300 launchers with 144 of the long-range surface-to-air missiles. They are said to be the equivalent to the US Patriot system.

    "We have consistently called on Russia not to provide a further supply of weapons to the Assad regime, including air defense systems that are particularly destabilizing to the region," White House press spokesman Jay Carney told journalists?on Thursday.

    "I think we have made it crystal clear that we would prefer that Russia is not supplying assistance," to Syria, Secretary of State John Kerry told journalists during a visit to Italy.

    "We have previously stated that [these] missiles are potentially destabilizing with respect to the state of Israel," he said.

    Israel has carried out two airstrikes on Syrian targets in the past week, dramatically raising the stakes in the Syrian civil war, which is now in its third year.

    Introduction of the S-300 into Syria's air defense arsenal could sharply limit the future options not only for Israel but for the US as well, should it decide to intervene in the conflict.

    The latest version of the S-300 reputedly has a range of 125 miles, can engage 12 targets simultaneously, and can strike missiles or aircraft at altitudes of up to 20 miles.

    The US and Israel waged a long and ultimately successful diplomatic campaign to persuade Russia to renege on a contract it had signed many years ago to provide S-300 missiles to Iran.

    But since agreeing in 2010 to cut off arms supplies to Iran, the Kremlin has dug in its heels and refused to sign on to any more sanctions against its dwindling number of client states.

    Russia has an estimated $5 billion in outstanding arms contracts with Syria, mostly sophisticated anti-aircraft weapons, tactical surface-to-surface missiles, submarines, warships, and training aircraft.

    Though Moscow has not yet commented on the allegation that it is preparing to deliver S-300s to Syria, Russian officials have repeatedly insisted that they are acting within the framework of international law in honoring arms contracts with a long-standing ally that is not subject to any United Nations-approved sanctions.

    Moscow also complains that the US continues to sell huge amounts of modern arms to its Arab clients, such as Saudi Arabia, some of whom it says are surreptitiously arming the Syrian rebels.

    The fresh accusations against Russia for supplying arms to Syria come just days after Mr. Kerry met with President Vladimir Putin in the Kremlin and agreed on the need for Russia and the US to combine efforts in a joint push to find a peaceful settlement to the spiraling Syrian conflict.

    (AP) ? Ahead of a nuclear-powered U.S. carrier's visit to South Korea, North Korea on Friday called this week's summit between the U.S. and South Korean presidents a prelude to war against Pyongyang. Yet it also said it was waiting "with patience" to see if Seoul changes its policies.

    The North described South Korean President Park Geun-hye's visit to Washington as a "despicable sycophantic trip to please her master."

    The summit between the two allies is "a curtain-raiser to a dangerous war to invade" the North, an unnamed spokesman for the North's Committee for the Peaceful Reunification of Korea told the official Korean Central News Agency. The committee deals with cross-border relations, which are at a low point.

    At the same time, the North Korean spokesman said Pyongyang is "following the present authorities in South Korea with patience," arguing that it is not Pyongyang but Seoul that should change its stance.

    North Korea unleashed a flurry of war threats last month, but there has been a lull of late. There are some tentative signs of interest in diplomacy, though Pyongyang has also kept up its criticism of both Seoul and Pyongyang.

    North Korea previously criticized the impending visit of the nuclear-powered aircraft carrier USS Nimitz. It and three other ships will arrive Saturday in the southeastern port city of Busan in a show of U.S. commitment in the region, the U.S.-South Korean Combined Forces Command said in a statement.

    Wee Yong-sub, deputy spokesman for the South Korean Defense Ministry, said Friday that the carrier will participate in a variety of annual naval exercises, including search and rescue operations.

    North Korea's military earlier this week threatened the United States and South Korea over their joint naval drills taking place this week, including anti-submarine drills ending Friday in tense Yellow Sea waters.

    Pyongyang sees American use of nuclear assets in the region as aimed at toppling its government. Amid North Korean threats of nuclear war in March, Washington took the unusual step of announcing the participation in big U.S.-South Korean military drills of nuclear-capable B-52 and B-2 bombers, drawing a furious response from Pyongyang.

    North Korea's Foreign Ministry said Friday in a statement that those drills posed the "biggest-ever nuclear threat" to Pyongyang, urging President Barack Obama to reverse what it called a hostile U.S. posture toward the North.

    Obama and Park met Tuesday in Washington and warned Pyongyang against nuclear provocations. Pyongyang conducted its third nuclear test in February and triggered a new round of U.N. sanctions against it.

    Park and Obama said after their summit that they are open to dialogue if Pyongyang moves toward nuclear dismantlement.

    Park took office in February with a pledge to build trust with North Korea through aid and other civilian exchanges. In a speech to Congress on Wednesday, she said the North's twin goals of developing nuclear arms and pursuing economic improvement are incompatible.

    The North Korean reunification spokesman called that slander.

    On Monday, Glyn Davies, top U.S. envoy dealing with North Korea, will travel to Seoul to meet with senior officials as part of a three-day trip that includes China and Japan, the State Department said.

    S&P 500 ends down, breaks string of record closes

    NEW YORK (Reuters) - The S&P 500 broke a five-day string of record closing highs on Thursday, ending a fairly volatile session lower as recent momentum lost steam and Apple shares declined.

    The Dow also broke its two-day string of all-time closing highs, but still ended above 15,000.

    The length of the recent rally has surprised many investors. Analysts said it's difficult for the upward momentum to continue without further catalysts, such as first-quarter earnings reports, which are nearing an end.

    Volume has been weak for much of this year's rally. In fact, volume has been below average all week.

    "This market is so stretched to the upside that if we get some little wiggle somewhere, I can easily see us getting back down to 1,580" on the S&P 500, said Stephen Massocca, managing director of Wedbush Equity Management LLC in San Francisco.

    Apple , down 0.9 percent at $456.77, led the declines of both the S&P 500 and the Nasdaq, while International Business Machines , down 0.8 percent at $203.24, was the biggest drag on the Dow.

    The day's economic data was mostly positive, but failed to give much of a boost to stocks. The number of Americans filing new claims for unemployment benefits fell last week to the lowest level in almost 5-1/2 years - contrary to economists' forecast of a gain - U.S. Labor Department data showed.

    The Dow Jones industrial average fell 22.50 points, or 0.15 percent, to end at 15,082.62. The Standard & Poor's 500 Index declined 6.02 points, or 0.37 percent, to finish at 1,626.67. The Nasdaq Composite Index slipped 4.10 points, or 0.12 percent, to close at 3,409.17.

    Despite the declines for the day, both the Dow and the S&P 500 reached all-time intraday highs - with the Dow touching 15,144.83 and the S&P 500 reaching 1,635.01.

    The market, which had been down slightly from the opening bell through midday, reversed course and began to edge higher in early afternoon. Stocks lost steam later in the session.

    Limiting losses on the S&P 500, News Corp shares gained 4.5 percent to $33.29. It reported earnings late Wednesday that beat expectations while revenue rose 14 percent. Rupert Murdoch's media company also said it was on track to split off its slow-growing publishing business by the end of June.

    Among other top advancers, Tesla Motors Inc surged 24.4 percent to $69.40 a day after posting adjusted earnings that were three times what analysts were expecting as the company sold more cars than it had initially forecast.

    Shares of Barnes & Noble Inc shot up 24.3 percent to $22.08, after hitting a fresh 52-week high of $22.25. The stock's sharp advance followed a report by web publication TechCrunch that Microsoft Corp was considering an offer to acquire all of Nook Media's digital assets for $1 billion. Microsoft shares slipped 1 percent to $32.66.

    Volume was roughly 6.3 billion shares traded on the New York Stock Exchange, the Nasdaq and the NYSE MKT, slightly below the average daily closing volume of about 6.4 billion this year.

    Decliners outnumbered advancers on the NYSE by a ratio of nearly 2 to 1 and on the Nasdaq, about three stocks fell for every two that rose.

    Biologist maps the family tree of all known snake and lizard groups

    May 8, 2013 ? A George Washington University biologist and a team of researchers have created the first large-scale evolutionary family tree for every snake and lizard around the globe.

    The findings were recently published in the journal BMC Evolutionary Biology. Alex Pyron, the Robert F. Griggs Assistant Professor of Biology in GW's Columbian College of Arts and Sciences, along with researchers from the City University of New York and Arizona State University, detail the cataloging of 4,161 species of snakes and lizards, or squamates.

    "Squamates include all lizards and snakes found throughout the globe, including around 9,500 species on every continent except Antarctica, and found in most oceans," said Dr. Pyron. "This is everything from cobras to garter snakes to tiny geckos to the Komodo Dragon to the Gila Monster. They range from tiny threadsnakes that can curl up on a dime to 10 feet monitor lizards and 30 foot pythons. They eat everything from ants to wildebeest."

    The evolutionary family tree, or phylogeny, includes all families and subfamilies and most genus and species groups, said Dr. Pyron. While there are gaps on some branches of the tree, the structure of the tree goes a long way toward fully mapping every genus and species group.

    "It's like building an incomplete family tree for your family, but with half of the 'children' sampled. You're in it, but not your brother, one of your cousins is, but not another. However, because it's so complete, we know where the missing relatives go because there's no longer as much mystery as to how the missing species, or cousins, are related, with a few notable exceptions for some remaining species.

    "This is also a community effort. We sequenced hundreds of these species ourselves but took thousands more from public databases, building on the work of others."

    Understanding how various snakes and lizards are connected to each other fills a major gap in knowledge, said Dr. Pyron, because before this, there were no single reference for how all lizards and snakes were related or what their classification was.

    "A phylogeny and taxonomy is fundamental for all fields of biology that use lizards and snakes, to understand how to classify the species being studied, to interpret biological patterns in terms of relatedness, and even at a more basic level, to count how many species are in an area, for example, for conservation management purposes."

    This project has been in the works since 2008 with the last five years being the most intense. It was funded by the National Science Foundation Postdoctoral Research Fellowship in Biological Informatics.

    The researchers used DNA sequencing technology to genotype, or identify, the DNA of thousands of lizards and snakes.

    "We have laid down the structure of squamate relationships and yet this is still the beginning," said Dr. Pyron. "As hundreds of new species are described every year from around the glove, this estimate of the squamate tree of life shows us what we do know, and more importantly, what we don't know, and will hopefully spur even more research on the amazing diversity of lizards and snakes."

    Battle for Dell continues as shareholders Icahn, Southeastern partner on an offer

    Michael Dell's deal with Microsoft to buy back the computer company bearing his name hasn't gone through yet, and tonight two of its largest shareholders joined forces on another option. Carl Icahn and Southeastern Asset Management have both opposed the $24.4 billion / $13.65 per share buyout proposal from the start and have an alternative proposal: a $12 per share dividend, funded by Dell's $9 billion in cash and $5.2 billion in new debt. If that's not accepted, the two also claim to be ready to put up a slate of 12 director's ahead of Dell's annual shareholder meeting, or take their challenge to the courts. Even with the reported withdrawal of a counter offer from Blackstone Group, things remain complicated -- we'll wait and see if any of these threats go through, or if they successfully wrangle a better buyout offer from Dell, Microsoft & Co.

    Giant Snail Menaces Houston Neighborhood

    If you live in Houston and you have a garden and you happen to see a giant snail and that giant snail begins oozing towards you ? run. Or walk away slowly.

    Just don?t touch it.

    The sluggish mollusk, recently photographed in the backyard of a quiet Houston neighborhood, has been tentatively identified as a Giant African Snail and wildlife researchers say it?s dangerous.

    ?The snail harbors a deadly parasite known as rat lungworm, which is a form of meningitis,? said Lori Williams, the executive director of the National Invasive Species Council, the coordinating body for the federal government on invasive species.

    Williams warned humans not to go near the snail and said that people who do touch it need to wash their hands thoroughly.

    What the insidious creature lacks in speed it makes up for in fertility. It reproduces rapidly and can lay 1,200 eggs a year. If confirmed as a Giant African snail, Williams noted that it?s unlikely there is just one.

    The softball-sized beast is also a considerable pest. It has been known to munch its way through stucco, plastic recycling bins, signs and more than 500 species of plants. Its pointy shell is so sharp is can blow out car tires if run over.

    First spotted in the U.S. in southern Florida in the 1960s, Williams said it took more than a decade and $1 million to eradicate but has recently been rediscovered in the sunshine state.

    This is the first known possible spotting of the giant snail in Texas. It?s a mystery how it got there.

    Its current location is also a mystery. Ironically, the snail slipped away and for the moment, has eluded capture. Local wildlife officials are sending teams into the area to search for it.
